Akito was murdered by Hatori.
If Hatori was standing in the yard and Akito was on the fourth floor, there's no way he could have “seen Akito kick the stool he was standing on” out from under him, because everything below the hips was hidden from view. Hatori was arrested and exiled, never to bother Tohru or any of the Sohmas ever again.
